These Terms and Conditions apply to your use of the Attune mobile application and related services (“Attune”).
Attune is operated by Daniel Serratore trading as Depth Lab, ABN 80 737 647 863 (“we”, “us” or “our”).
By creating an account or using Attune, you agree to these Terms. Please read them together with our Privacy Policy.
If you have any questions, you can contact us at support@attuneprayer.com.
1. About Attune
Attune is a prayer app designed to help people engage with prayer, reflection and the Christian spiritual tradition through guided prayers, audio, journeys, personal reflections and related content.
Attune is intended as a prayer and contemplative resource. It is not medical care, psychological therapy, counselling or an emergency or crisis service. Nothing in Attune should be treated as medical, psychological or other professional advice.
You remain responsible for your own decisions and for seeking appropriate professional or personal support when needed.
2. Who may use Attune
You must be at least 18 years old to create or use an Attune account.
We do not ask users to provide their date of birth. However, if we become aware that an account belongs to someone under 18, we may suspend or close the account and delete the associated data in accordance with our Privacy Policy.
3. Your account
You may create or access an Attune account using the sign-in methods made available through the app, which may include email and password, Sign in with Apple and Google Sign-In.
You are responsible for keeping access to your account secure and for notifying us if you believe your account has been accessed without your permission.
You must provide information that is accurate and must not impersonate another person or create an account for fraudulent or unlawful purposes.
5. Free trials and automatic renewal
Premium subscriptions are purchased and managed through Apple’s App Store.
Unless you cancel before the end of your free trial, your trial will automatically convert to the Premium subscription you selected and Apple will charge your nominated payment method.
To avoid an unwanted renewal or charge, you should cancel through your Apple subscription settings before the renewal date. Apple recommends cancelling a trial at least 24 hours before it ends.
Paid subscriptions automatically renew for the applicable monthly or annual subscription period unless cancelled through Apple.
Attune does not receive or store your full payment card or bank account details.
6. Cancelling a subscription
You can cancel your Premium subscription through your Apple account or App Store subscription settings.
If you cancel a paid subscription, you will ordinarily continue to have Premium access until the end of the subscription period you have already paid for. You will not be charged for a further period after cancellation unless you subscribe again.
When Premium access ends, you may continue to use the free parts of Attune.
Ending or cancelling Premium access does not by itself delete your Attune account or your personal notes and reflections.
7. Refunds
Because Attune subscriptions are purchased through Apple’s App Store, refund requests relating to App Store transactions should ordinarily be submitted through Apple’s refund process.
Apple determines refunds for transactions processed through the App Store in accordance with its policies.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
If you believe Attune has failed to meet a consumer guarantee or you have a problem that is not appropriately resolved through Apple, you may contact us at support@attuneprayer.com.
8. Your notes, reflections and other personal content
Attune allows you to create private notes, journal entries, reflections and other personal content.
You retain ownership of the content you create.
By default, your notes and reflections are stored securely in Attune’s cloud infrastructure so they can be saved to your account and made available to you when you use Attune across different devices.
You may instead choose “Keep notes on this device” in your Profile settings. When this option is enabled, notes on that device are stored locally on that iPhone rather than in Attune’s cloud and will not sync to your other devices.
If you move existing cloud-stored notes to device-only storage, Attune will delete the corresponding copies from its live cloud systems. If deletion cannot be completed immediately because of a temporary technical or connectivity issue, Attune will take reasonable steps to complete it when the service is next able to do so.
Your personal reflections are private account content. Attune does not routinely access, read or review cloud-stored notes, and notes are not used for advertising, marketing or analytics.
Where notes are stored in Attune’s cloud, access is restricted. Authorised technical personnel may access stored content only where reasonably necessary to maintain or secure the service, investigate or resolve a technical problem, or comply with a legal obligation.
You give us a limited permission to host, store, back up, transmit and process cloud-stored content only as reasonably necessary to provide, maintain and secure Attune and as otherwise described in our Privacy Policy.
9. Acceptable use
You must not use Attune to:
- attempt to access another person’s account or private data;
- interfere with, damage or disrupt Attune or the systems used to provide it;
- circumvent security or access controls;
- introduce malicious software or code;
- scrape, systematically extract or reproduce Attune’s content or data without permission;
- impersonate another person or engage in fraud;
- infringe another person’s intellectual property rights; or
- use the service in a way that is unlawful.
These rules concern misuse of the service itself. They are not intended to regulate what you write privately in your own prayer notes or reflections.
10. Attune content and intellectual property
Except for material that is in the public domain or owned by third parties, the content made available through Attune, including original prayer scripts, recordings, audio, written content, design elements, branding, graphics and software, is owned by us or used by us with permission.
Your use of Attune gives you a personal, limited and non-commercial right to access this material through the app. It does not transfer ownership of the material to you.
You must not reproduce, sell, redistribute, publish, commercially exploit or create substantial derivative collections from Attune’s proprietary content without our permission.
You may take and share screenshots of Today’s Moment for ordinary personal and non-commercial purposes.
This permission does not extend to copying or redistributing full prayer scripts, audio recordings, paid collections or substantial portions of Attune’s library.
Public-domain material remains in the public domain, and material owned by a third party remains the property of the relevant rights holder.
11. Availability and changes to Attune
We intend to keep Attune available and functioning reliably, but digital services can experience interruptions, maintenance periods, technical problems and circumstances outside our reasonable control.
We may add, remove or change prayers, journeys, features or other parts of Attune as the service develops.
We will try to avoid materially reducing a service that you have already paid for without good reason. Nothing in this section limits any rights you have under Australian Consumer Law.
We may also discontinue Attune or a substantial part of the service. Where reasonably practicable, we will provide advance notice if doing so materially affects existing users.
12. Suspension or termination
We may suspend or restrict an account where reasonably necessary to:
- protect Attune, its systems or other users from a security threat;
- respond to attempted hacking or unauthorised access;
- address fraud or deliberate misuse of the service;
- comply with the law; or
- respond to a serious or repeated breach of these Terms.
Where circumstances allow, we will generally try to give you notice and a reasonable opportunity to address the issue before permanently terminating your account.
We may act immediately where necessary to protect the security of Attune or comply with a legal obligation.
We will not suspend or terminate your account merely because of the thoughts, feelings, doubts, experiences or other content you record in a private reflection.
13. Deleting your account
You can delete your Attune account from within the app.
Deleting your account removes your active Attune account and associated personal content from our live systems, including your private notes and reflections.
Some information may remain temporarily in secure system backups until those backups expire or are overwritten. We may also retain limited records where reasonably necessary to meet legal, accounting, security or dispute-resolution obligations.
More information is provided in our Privacy Policy.
Deleting your Attune account does not cancel a subscription managed by Apple. If you have an active Premium subscription, you should cancel it through Apple before or when deleting your Attune account if you do not want the subscription to renew.
14. Third-party services
Attune relies on services provided by other organisations to operate parts of the app, such as account authentication, cloud hosting, content delivery, analytics and App Store subscriptions.
Your use of some of these services may also be subject to the terms and privacy practices of the relevant provider.
Attune’s iOS application is also subject to the applicable Apple App Store terms and Apple’s standard end-user licence agreement unless another licence expressly applies.
15. Consumer rights and our responsibility
Nothing in these Terms excludes, restricts or modifies any guarantee, right, condition or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
Subject to those rights, we do not guarantee that Attune will always be uninterrupted, error-free or available on every device or operating-system version.
Attune provides prayer and reflective material rather than professional advice. You are responsible for the personal decisions you make and for determining whether particular spiritual practices or content are appropriate for you.
To the extent permitted by law, we are not responsible for indirect or consequential loss that was not reasonably foreseeable or for loss caused by circumstances outside our reasonable control.
Nothing in these Terms is intended to exclude responsibility where it would be unlawful to do so.
16. Changes to these Terms
We may update these Terms where reasonably necessary, including when Attune changes, our business practices change or legal requirements change.
If a change is material, we will take reasonable steps to bring it to your attention, such as through the app, our website or email.
The updated Terms will state their effective date.
Your continued use of Attune after updated Terms take effect means the updated Terms will apply to your subsequent use, subject always to any rights you have under applicable law.
17. Governing law
These Terms are governed by the laws of Victoria, Australia and the applicable laws of the Commonwealth of Australia.
You and we submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them.
This clause does not limit any rights you may have under consumer laws that apply to you in another jurisdiction.
